Panel does not disappear when set to "can be covered by windows"

Hi there :)
When I set my panel to "windows can cover" and use the global menu, it does not disappear afterward.
I attach a video, to showcase.
- Open any application
- Set panel to "can be covered by windows"
- Use the global menu and click into the running application beneath it
Observed result
Panel does not disappear
I expect that..
