Raspberry pi 4 fbturbo.conf issue latest bullseye Lite

On the below latest release of Raspbian Lite on RPI4 I'm seeing the below error when trying to startx
Using Xorg

deleting the 99-fbturbo.conf file from /usr/share/X11/xorg.conf.d/ removes the error but I then can't use the TFT as I would like

Using the same config on the RPI3 shows no issues

The error on occurs on the RPI4 when the overlays are added to the /boot/config.txt file
dtoverlay=tft35a:rotate=90
