The person that you have stated can do whatever they want with this code...
The License of this repo states that you can "distribute" this software and "copy" this software...
That is the whole point of a open source license.

This whole project its self is a fork / modified copy of another project called v86 which is a virtual machine that can run in your web browser once again stated in the license.
This software is also provided without any warranty's
And no where in this repo https://github.com/5R33CH4/Windows95 does he say the code belongs to him. He does not credit @felixrieseberg but also doesn't say it belongs to him.
And finally this is a copy from when this project first came out and many people where excited about it so it makes sense for people to "fork" it.
